Terms of Service

These Terms of Service ("Terms") govern your use of the website and services provided by NALA- Digital Marketing Services ("NALA," "we," "us," or "our"), a business name registered with the Department of Trade and Industry (DTI), Philippines, under DTI Business Name No. 8397254, operating out of Talon Dos, City of Las Piñas, NCR. By accessing our website or engaging our services, you agree to these Terms.
1. Our services
NALA provides digital marketing services, including but not limited to social media management, paid advertising campaign setup and management, content and creative production, and marketing consultation for small and growing businesses.
2. Engaging our services
Specific scope, deliverables, timelines, and rates for any project are agreed upon directly with the client before work begins, typically via email or messaging channels such as WhatsApp or Facebook. Any such agreement forms part of these Terms for that engagement.
3. Client responsibilities
- Providing timely access to accounts, assets, and information needed to deliver the service (e.g. ad account access, brand assets, product information).
- Reviewing and approving content or campaigns within agreed timeframes.
- Ensuring that materials provided to us (images, copy, claims, offers) are accurate and that the client has the right to use them.
4. Payments
Payment terms (rates, schedule, and method) are agreed upon per client before work begins. Any third-party costs, such as advertising ad spend paid directly to platforms like Meta or Google, are separate from our service fees unless otherwise agreed in writing.
5. Advertising platform policies
Paid campaigns run through third-party platforms (such as Meta) and are subject to that platform's own terms, advertising policies, and approval processes. We work to follow platform guidelines, but we do not control, and are not liable for, decisions made by third-party platforms, including account restrictions, ad rejections, or changes to platform policy.
6. Intellectual property
Unless otherwise agreed, creative assets developed specifically for a client as part of a paid engagement become the property of the client upon full payment. NALA retains the right to showcase completed work in its own portfolio and marketing materials, unless the client requests otherwise in writing.
7. Confidentiality
We treat client account access, business information, and campaign data as confidential and will not share it with third parties except as needed to deliver the service or as required by law.
8. Limitation of liability
We aim to deliver services with reasonable skill and care, but we do not guarantee specific business outcomes, such as sales, leads, follower counts, or return on ad spend, since these depend on many factors outside our control. To the extent permitted by law, our liability for any claim arising from our services is limited to the fees paid for the specific service giving rise to the claim.
9. Termination
Either party may end an engagement in accordance with the notice period agreed for that project. Fees for work already performed remain payable.
10. Governing law
These Terms are governed by the laws of the Republic of the Philippines.
11. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision.
